The problem

From January 2027, getting a dismissal wrong gets expensive.

On 1 January 2027 the qualifying period for unfair dismissal drops from two years to six months, and the cap on compensation is removed. The six-month rule covers people already on your payroll, so on that date everyone with six months' service can claim. That takes in about eighteen months of hires who are not protected today, and anyone newer follows as they reach six months.

Tribunals judge a dismissal against your own written procedure and the Acas Code, and can raise the award by up to 25% where an employer unreasonably failed to follow the Code. That procedure lives in your handbook.

Day-one sick pay and family leave are already in force. Tribunal time limits double on 1 October 2026 and the expanded harassment duties land on 30 October 2026. A handbook written before December 2025 does not reflect any of this.

Is an employee handbook a legal requirement in the UK?
No. UK law does not require a handbook, but it does require certain things in writing. Every employee must receive a written statement of particulars under section 1 of the Employment Rights Act 1996, which must refer to your disciplinary and grievance procedures, and employers with five or more staff must have a written health and safety policy. A handbook is where most employers keep those policies and the others a tribunal will ask to see.
What is the Employment Rights Act 2025?
The Employment Rights Act 2025 is the most significant shake-up of UK employment law in a generation. Reforms are phased across 2026 and 2027: day-one statutory sick pay and family leave arrived in April 2026; expanded sexual harassment duties and tribunal time limits doubling to six months arrive in October 2026; from January 2027 the unfair dismissal qualifying period drops to six months and the cap on compensation is removed; guaranteed hours for zero and low-hours workers follow in 2027. Do I need to update my existing handbook?
